Individual Healthcare Mandate NOT a Tax

Obama’s individual healthcare mandate, as ruled by Justice Roberts, is not a tax. A tax uses formulaic equations which apply to a broad range of applications, such as a 6% sales tax in a certain county, or a tax bracket into which individual Federal taxpayers may fall. Since insurers utilize many variable factors to determine an individual’s premium payment cost, this “individualized factor” is way too variable a condition to apply under the definition of a tax. This ruling is, of course, wrong.
